1. Acceptance of Terms
By accessing or using NikoSafe Story (the "Service"), operated by NikoSafe LLC ("NikoSafe", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. You must be at least 18 years old to create an account and use the Service.
2. Description of Service
NikoSafe Story is a platform that enables parents and guardians to create personalized, AI-generated storybooks for children. The Service includes digital story creation, audiobook generation, print-on-demand ordering, digital gifting, and parent analytics dashboards. All stories undergo clinical review before release.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be a parent or legal guardian to create child profiles and provide child information.
- You agree that all information you provide is accurate and complete.
- You are responsible for all activity that occurs under your account.
4. AI-Generated Content
- Story text and illustrations are generated by artificial intelligence systems based on the information you provide.
- While we employ strict safety guardrails and clinical review, AI-generated content may occasionally contain imperfections.
- You may edit story text after generation using the built-in editor.
- NikoSafe reserves the right to review and withhold content that does not meet our safety standards.
5. Clinical Review
All stories generated on NikoSafe undergo review by our clinical team, which includes professionals with expertise in child development. Clinical review ensures stories meet NikoSafe Standards for age-appropriateness, positive values, and emotional safety. Stories may be held for revision if they do not meet these standards.
6. Subscriptions & Payments
- Free accounts are limited to features as described on our Pricing page.
- Paid subscriptions (Starter, Premium) are billed monthly through Stripe.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Print orders, gift purchases, and one-time purchases are non-refundable once the order has been submitted to our print partner.
- Refund requests for digital content may be submitted to support@nikosafestory.com within 7 days of purchase.
7. Intellectual Property
- You retain ownership of the personal information you provide.
- AI-generated stories created for your account are licensed to you for personal, non-commercial use.
- You may share, print, and gift stories created through your account.
- You may not resell, redistribute, or commercially exploit the AI-generated content without written permission.
- The NikoSafe name, logo, and branding are trademarks of NikoSafe LLC.
8. Prohibited Uses
- Attempting to generate inappropriate, harmful, or abusive content.
- Using the Service for any unlawful purpose.
- Creating accounts for children (only parents/guardians may create accounts).
- Impersonating another person or providing false information.
- Attempting to access another user's account or data.
- Reverse engineering, scraping, or automating interactions with the Service.
9. Limitation of Liability
The Service is provided "as is" without warranties of any kind. NikoSafe shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to NikoSafe in the twelve months preceding the claim.
10. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the Parent Dashboard. Upon termination, your right to use the Service ceases, and we will delete your data in accordance with our Privacy Policy.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or prominent notice. Continued use of the Service after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state in which NikoSafe LLC is registered.
